1. Acceptance of Terms
By downloading, installing, or using Momentum Mouse ("the App") or by backing the Momentum Mouse crowdfunding campaign and redeeming any associated reward, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. The App
Momentum Mouse is a software application published by The Mirth Co. that turns an Android device into a wireless mouse and voice keyboard for a paired computer. The App is provided "as is" and "as available." We make no warranty that it will be uninterrupted, error-free, or compatible with every device.
3. Subscriptions
The App is offered on a monthly and yearly subscription basis through Google Play Billing. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You may cancel at any time through your Google Play account. Refunds are governed by Google Play's refund policy.
4. Crowdfunding Backer Rewards
Backers of the Momentum Mouse crowdfunding campaign receive digital and (for selected tiers) physical rewards in addition to App licenses. Physical rewards ship from Taiwan via tracked mail on the dates listed on the campaign page. License codes are delivered by email.
App licenses granted as backer rewards are non-transferable except where a tier explicitly includes a "gift code," in which case the gift code may be redeemed by one (1) recipient of the backer's choice.
5. License Terms — Subscriptions and Fixed-Term Backer Licenses
Subscriptions and fixed-term backer licenses (1 month, 1 year, 2 years, 5 years) grant you a non-exclusive, non-transferable right to use the App for personal or business use during the licensed period. The licensed period begins when you redeem the license code and ends at the conclusion of the term.
6. Lifetime License Terms
A small number of backers at the highest crowdfunding tier receive a "Lifetime License" to Momentum Mouse. The following terms govern Lifetime Licenses specifically and supersede any conflicting language elsewhere:
- Definition. "Lifetime" means the lifetime of the Momentum Mouse service in its substantially current form, not the lifetime of the individual licensee.
- Successor and assignment. The Mirth Co. may assign, transfer, or merge the Momentum Mouse service and these Lifetime Licenses with a successor entity, parent company, acquirer, or licensee (including under an exclusive OEM, hardware-bundling, or platform-licensing arrangement). In any such transfer, Lifetime Licenses transfer with the service and continue in force under the successor.
- Material change or discontinuation. If the Momentum Mouse service is discontinued, materially rebranded, ported exclusively to a different platform that the Lifetime licensee cannot reasonably access, or otherwise materially changed such that the original Lifetime License cannot be honoured in substantially its original form, The Mirth Co. will, at its option, either (a) provide the licensee with continued access to the successor or equivalent service at no additional cost, or (b) refund the original purchase value of the backer tier (USD $499 or local equivalent at time of purchase).
- Platform coverage. Lifetime Licenses cover Momentum Mouse on Android and on any future platforms (iOS, Windows, macOS) released by The Mirth Co. as part of the Momentum Mouse product family. Coverage does not extend to unrelated products released under different product names.
- Account binding. Lifetime Licenses are bound to the email address used at backer redemption and are non-transferable except where the tier explicitly includes a Lifetime Gift Code.
The intent of this section is to honour our commitment to founding backers while preserving the flexibility necessary to negotiate future hardware, platform, or OEM partnerships that benefit the Momentum Mouse community as a whole.
7. Acceptable Use
You agree not to reverse engineer, decompile, or attempt to extract the source code of the App except as permitted by law. You agree not to use the App to send unsolicited data to systems you do not own or do not have permission to control.
8. Disclaimer of Warranties
The App is provided without warranty of any kind, express or implied. The Mirth Co. is not liable for any indirect, incidental, or consequential damages arising from use of the App.
9. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the App after a revision constitutes acceptance of the updated Terms. Material changes affecting Lifetime Licenses will be communicated to affected licensees by email.
